Terms of Service

These Terms of Service (the "Terms") are an agreement between you and Streamfog Inc. ("Streamfog", "we", "us") and govern your use of ClaraCam: the desktop applications for macOS and Windows, the account, sync, and billing services behind them, and this website (together, the "Service"). By creating an account or using ClaraCam you agree to these Terms and to our Privacy Policy andRefund Policy, which are part of them. If you don't agree, don't use the Service.

If you are using ClaraCam on behalf of a company, you represent that you have authority to bind that company, and "you" means the company.

1. What ClaraCam is

ClaraCam is desktop software that installs a virtual camera on your computer and applies real-time, on-device enhancement to your physical camera's video. Video processing happens entirely on your machine; the online part of the Service exists only to manage your account, sync your settings, and handle billing. System requirements: macOS 14 or later, or Windows 11 (build 22000 or later), with camera access enabled for desktop apps.

2. Your license (EULA)

While your trial or subscription is active, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the ClaraCam apps on the devices you personally use. A Teams plan grants the same license to each licensed seat. This is a license, not a sale — we and our licensors retain all rights in the software, models, and Service.

3. Your account

You sign in with a Google or Microsoft account. Keep your sign-in method secure: you are responsible for activity on your account. Provide accurate information, and use one account per person — the free trial is tied to your account and is available once.

4. Free trial

New accounts get a 7-day free trial with full functionality. No payment method is required. The trial starts when you first sign in, is tracked on our servers, and is not reset by reinstalling or switching machines. When it ends, enhancement stops working until you subscribe; we don't charge you anything automatically, because we never took a card.

6. Updates and changes to the Service

The apps check for and install signed updates automatically so that everyone runs a current, secure version. We may improve, add, or retire features over time. If we ever discontinue the Service entirely, we will give subscribers reasonable notice and refund any prepaid, unused period.

Your video never leaves your machine. What little data the Service does handle is described in the Privacy Policy.

8. Feedback

If you send us feedback or suggestions, we may use them without obligation to you.

9. Acceptable use of appearance enhancement

ClaraCam enhances how your real camera feed looks; it does not create synthetic people or replace your likeness with someone else's. You are responsible for your use of your own video. Don't use ClaraCam in contexts where appearance enhancement is prohibited by law, regulation, or a rule that binds you (for example, certain identity-verification processes).

10. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that every camera, machine, or meeting app will be compatible, or that enhancement results will meet your expectations. Nothing in these Terms limits warranty rights that consumer law gives you and does not let you waive.

11. Limitation of liability

To the maximum extent permitted by law: (a) neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data; and (b) our total liability for all claims arising out of the Service is limited to the amount you paid us in the 12 months before the claim arose (or US $50 if you paid nothing). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

If you use the Service on behalf of a business, that business will defend and indemnify Streamfog against third-party claims arising from its breach of these Terms or unlawful use of the Service.

13. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms (including license circumvention or abuse), and will tell you why unless the law prevents it. Sections that by their nature survive (including 2, 8, and 10–15) survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Delaware. If you are a consumer in the EU, UK, or another jurisdiction with mandatory consumer protections, you keep the protections and forum rights of your country of residence.

15. General

These Terms (with the policies they reference) are the entire agreement between us about the Service. If a provision is unenforceable, the rest stands. Our not enforcing a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We may update these Terms; for material changes we will give notice (on this page, in the app, or by email) before they take effect, and continued use after that constitutes acceptance.
